Whying Company Limited (hereinafter referred to as ‘the Company’) is the owner and administrator of the personal medication care application, PharmaSafe mobile application, and “https://www.pharmasafeweb.com” website (hereinafter referred to as ‘the System’). User of the System must accept the Terms of Service. User is required to thoroughly read through this Terms of Service before accessing the System; and by accessing the system, such User will be deemed to have accepted the Terms of Services, which effect legal binding between the Company and the User. This includes giving of the User’s consent so that the Company may collect, use, and/or perform any actions, as stated in our Personal Privacy Protection Policy, with your personal information. If you do not accept this Terms of Service herein, please do not access the System.

Disclaimer

The Company created the System with the intention to provide a personal medication care application, which gives you personal advice on medication that you’ve received from medical institution, via electronic channel. The System is an alternative for informational assistant, in order to make your medication usage more efficient and safer. The System is not a medical tool for diagnosis and patient must strictly and mainly follow the given diagnosis result and instruction of the doctor or pharmacist of your medical institution. Also, the Company does not guarantee the accuracy and up-to-date of the System’s information; and reserves the right to make any change and modification to this Terms of Service of the System without the need to inform you in advance.

Intellectual property and copyright

The Company owns the copyright, logo, trademark, as well as any other components of the System, including but not limited to, article, image, message, symbol, motion picture, advertisement media, graphic animation, and design. All of the above are being protect by law which forbids any forms of replication, copying, transcribe, modification, dissemination, or any other actions, whether for commercial purpose or for general public, unless it has been approved by written consent from the Company.

Limitation of Liability

The Company reserves the right not to be responsible for any damage, expense, and loss that may occur whether directly or indirectly from the System, including but not limited to, accuracy of the information, latency in data transferring, period of time for information dissemination, connection problem or obstacle, display error, system stability, computer virus, as a result of using the System. All of the above are your own risks. Also, accuracy of information, presentation format, virus computer attack, data theft, and connection are neither verified nor certified by the Company.

The Company may reveal some information and data from usage of the System, which have been collected as necessary, for the purpose of improving the quality of medication care services to the User of medical institutes, healthcare providers, pharmaceuticals, or healthcare related agencies. Also, the Company may reveal your information if it is requested to do so, pertaining to the following cases. Following legitimate order of the court, government authority and agency, once it has been requested; for the purpose of legal processing, or any other purposes, as the law requires. Following the request from your medical institute or healthcare provider, that you are receiving medical attention, as state in the System Following the request from you or your representative, where you give permission so the Company may reveal such information.
